COPYRIGHT ENFORCEMENT
When copyright infringment occurs, the owner is entitled to file a
lawsuit in federal court.
The court can issue injunctions and restraining orders to prevent further
violations, aware monetary damages, and award attorney fees.
Statutory damages of $500-$100,000 can be awarded. However, the work
must be registered with the Copyright Office.
COMMON LEGAL DEFENSES FOR INFRINGEMENT
Too much time has elapsed between the infringing act and the lawsuit
(Statue of limitations).
Fair use.
The infringment was innocent (infringer unaware item protected
by copyright).
The infringing work was created independently.
The copyright owner authorized use in a license.
